In a landmark move toward Ease of Doing Business, the Central Board of Indirect Taxes and Customs (CBIC) has officially launched its most ambitious trade facilitation measure to date: the Trust-Based Customs Clearance System.

As of April 2026, the traditional delays at Indian ports are being replaced by automated, near-instant releases for compliant businesses. But the big question remains: Is your business in the “Trusted” circle?

What is ‘Trust-Based’ Clearance?

Previously, almost every shipment underwent some level of manual intervention or risk-based assessment before being granted an “Out of Charge” (OOC). Under the new 2026 guidelines, the system now uses Advanced AI-driven Risk Management (RMS) to grant Auto OOC – releasing goods the moment the Bill of Entry is filed and duty is paid (or deferred), without a Customs Officer ever needing to touch the file.

The Star Player: The EMI Scheme (Circular 08/2026)

Introduced in the 2026 Budget, the Eligible Manufacturer Importer (EMI) scheme is the centerpiece of this trust-based revolution.

  • Deferred Payment: Approved EMIs can clear cargo now and pay duties later (on a monthly basis).
  • Auto-Registration: Goods registration on arrival is now fully automated for EMIs, removing the need for manual web-based queues.
  • Validity: This pilot scheme is active from April 1, 2026, to March 31, 2028.

Eligibility: Are You Qualified?

To benefit from “Immediate Release,” your business must meet specific benchmarks:

  • AEO Status: Holders of AEO-T2 and AEO-T3 status are automatically granted the highest level of trust and Auto-OOC.
  • Compliance Footprint: For non-AEOs, you need a minimum of 25 successful Customs filings (10 for MSMEs) with zero major compliance infractions.
  • Financial Solvency: You must demonstrate a clean GST record and financial stability (Turnover > ₹5 Crore).
  • Direct Port Delivery (DPD): Importers already utilizing DPD are prioritized for the new Auto-OOC features.

How to Transition Your Supply Chain

If your cargo is still stuck in “Assessment” or “Examination” for days, you are losing money on demurrage. To shift to the Trust-Based model:

  1. Upgrade to AEO-T2: Move beyond basic T1 documentation. T2 requires physical verification but unlocks the “Immediate Release” gate.
  2. Apply for EMI: If you are a manufacturer, apply on the aeoindia.gov.in portal under the new “EMI” tab.
  3. Leverage ICEGATE 2.0: Ensure your DSC and Payment Aggregators are correctly linked to utilize the Customs ePayment Platform (CeP) 2.0 for instant duty reconciliation.

The shift to trust-based clearance means the “Penalty for Error” is now much higher. While you get faster clearance, a single misclassification can lead to your “Trusted” status being revoked instantly.
