After years of waiting, the Goods and Services Tax Appellate Tribunal (GSTAT) is finally becoming a reality. The government has operationalized the e-filing GSTAT portal, marking a major relief for taxpayers with pending litigations.
If you have a rejected GST appeal stuck in limbo, now is the time to act.
Is GSTAT Fully Operational?
Yes. As of January 2026, the GSTAT is functional.
- GSTAT Operational Status: The Principal Bench (New Delhi) and notified State Benches are active.
- Portal Live: The dedicated efiling.gstat.gov.in portal is accepting appeals.
- Members: 83 Judicial and Technical Members have assumed charge as of January 21, 2026.
While physical hearings are ramping up, the digital infrastructure to accept your appeals is ready. You do not need to wait for a physical bench inauguration to file your application.
The “Golden Window” for Backlog Cases (Deadline: June 2026)
This is the most critical update for 2026. Many taxpayers have appeal orders that were passed months or years ago but couldn’t be filed because the Tribunal didn’t exist.
The Deadlines (Notification S.O. 4220(E))
The government has provided a one-time window to clear this backlog.
| Order Communicated Date | GSTAT Appeal Filing Deadline 2026 |
| On or Before April 1, 2026 | June 30, 2026 (One-time Extension) |
| After April 1, 2026 | Within 3 Months (Normal Provision) |
Staggered Filing Windows (To Avoid Portal Crashes)
To prevent the GSTAT portal login from crashing due to heavy traffic, the President of GSTAT has issued a “Staggered Filing” schedule based on when your First Appeal was filed.
- Feb 1, 2024 – May 31, 2024: File between Jan 1, 2026 – Jan 31, 2026
- June 1, 2024 – March 31, 2026: File Feb 1, 2026 onwards
- Missed your slot? Don’t worry. You can still file any time before the final cutoff of June 30, 2026.
Key Relaxations for Initial Filers
Recognizing the newness of the system, the Hon’ble President of GSTAT has granted major practical relief for the first 6 months (as per Office Order dated Jan 20, 2026):
- Defects: Only “material defects” will be pointed out; minor technical errors may be overlooked.
- No Certification: Documents downloaded from the GSTN portal do not need to be certified.
- Signatures: Physical signatures are required only for scanned physical documents, not digital ones.
How to File Appeal in GSTAT (Checklist)
Before you log in to efiling.gstat.gov.in, ensure you have the following ready to avoid rejection:
1. GSTAT Pre-Deposit Amount
You cannot file an appeal without paying the mandatory pre-deposit.
- Tax Disputes: You must pay 10% of the remaining disputed tax (capped at ₹20 Crores per Act).
- Note: This is in addition to the 10% you already paid at the First Appeal stage.
- Penalty-Only Disputes: 10% of the disputed penalty (effective from Oct 1, 2025).
2. Required Documents
- Form GST APL-05: The main appeal form.
- Certified Copy: Of the Order-in-Appeal (OIA) passed by the Commissioner (Appeals).
- Appeal Fees: ₹1,000 per ₹1 Lakh of disputed tax (Min: ₹5,000 | Max: ₹25,000).
FAQ: Common Client Queries
Q1: What is the GST appeal time limit 2026 for old cases?
Ans: For any order received before April 1, 2026, the final deadline is June 30, 2026.
Q2: Where do I file the appeal?
Ans: All appeals must be filed online at efiling.gstat.gov.in. Manual filing is not allowed without special permission.
Q3: What happens to my GST tribunal backlog cases?
Ans: You must file them individually on the new portal. They are not automatically transferred. If you miss the June 30, 2026 deadline, your demand will become permanent and recoverable.
Conclusion
The GSTAT is no longer a “future plan” – it is here. Don’t let your old litigation expire because you missed the backlog window.
Need Help Drafting Your GSTAT Appeal?
Tribunal drafting requires precise legal grounds, not just factual arguments. As the final fact-finding authority, any document you miss here cannot be used in High Court later.
